Welcome to Chinese Name Generator. By accessing or using our website at www.hanzilab.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

Service Description

Chinese Name Generator provides AI-powered tools for Chinese language and culture, including:

• Chinese Name Generator: AI-assisted generation of Chinese names based on user-provided criteria, including Ba Zi (八字) analysis.
• Tracing Worksheet Generator: Custom printable Chinese character tracing worksheets.
• Ba Zi Analysis: Basic Five Elements and Ba Zi analysis for entertainment and educational purposes.
• API Access: Programmatic access to certain tools for approved developers (subject to separate API Terms).

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.

User Accounts

To access certain features, including paid subscriptions and saved content, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You may not create accounts by automated means or create multiple accounts for abusive purposes. We reserve the right to suspend or terminate accounts that violate these Terms.

Subscriptions & Payments

Chinese Name Generator offers both free and paid subscription plans. Paid subscriptions are billed as follows:

• Monthly Plan: Billed monthly in advance. Access to premium features continues until the end of the paid period upon cancellation.
• Yearly Plan: Billed annually in advance. May include additional benefits such as discounted pricing or bonus features.
• Lifetime Plan: One-time payment for permanent access to premium features. Subject to the Service remaining operational.

All prices are listed in USD. Taxes may apply based on your location. Payment is processed securely by our third-party payment processors (Stripe, PayPal). By providing payment information, you authorize us to charge the applicable fees.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can manage or cancel your subscription from your account settings.

Refund Policy

Our refund policy is detailed in a separate document. Please refer to our Refund Policy for full details. In summary:

• Monthly Plan: 14-day money-back guarantee.
• Yearly Plan: 30-day prorated refund.
• Instant PDF Reports (Ba Zi): No refunds, though quality disputes are reviewed case by case.

Intellectual Property

All content, trademarks, code, and materials on the Service, including the Chinese Name Generator name and logo, are owned by or licensed to Chinese Name Generator. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

Output generated by the AI tools (e.g., generated names, worksheets, analysis reports) is provided for personal use. You may use, print, and share generated content for non-commercial purposes. Commercial use of generated content requires a separate license.

Prohibited Uses

You agree not to use the Service for any unlawful purpose or in violation of these Terms. Prohibited uses include, but are not limited to:

• Uploading or transmitting viruses, malware, or other malicious code
• Attempting to access, probe, or scan the Service's infrastructure without authorization
• Interfering with or disrupting the Service, servers, or networks
• Using the Service to generate content that is discriminatory, harassing, or otherwise harmful
• Circumventing any access restrictions, payment mechanisms, or rate limits
• Scraping, crawling, or extracting data from the Service without our permission
• Using the Service for automated decision-making that affects legal rights
• Using the Service in violation of OpenAI's Usage Policies when using AI-powered features

Violation of these prohibitions may result in immediate termination of your access without refund.

User-Generated Content

You retain ownership of any content you submit to the Service (such as birth details for name generation or custom worksheet content). By submitting content, you grant Chinese Name Generator a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing the Service to you.

Third-Party Services

The Service integrates with third-party services, including OpenAI for AI processing, Stripe and PayPal for payment processing, and Cloudflare for content delivery. Your use of these services is subject to their respective terms and privacy policies. Chinese Name Generator is not responsible for the actions of these third parties.

Limitation of Liability

To the fullest extent permitted by applicable law:

• Chinese Name Generator provides the Service "as is" and "as available" without warranties of any kind, either express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
• In no event shall Chinese Name Generator, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with the Service.
• Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
• The AI-generated outputs provided by the Service (names, Ba Zi analyses, etc.) are for entertainment and educational purposes only. We make no guarantees regarding accuracy, cultural appropriateness, or suitability for any specific purpose.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Chinese Name Generator, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or violation of any rights of a third party.

Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice, if you violate these Terms. Upon termination, your right to use the Service will immediately cease. If we terminate for cause, no refund will be provided. You may terminate your account at any time from your account settings.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction of these courts. As an exception, either party may seek injunctive relief in any court with jurisdiction to protect its intellectual property rights.

Dispute Resolution

Before initiating legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@hanzilab.com. We will respond within 15 business days. If the dispute cannot be resolved within 30 days, either party may pursue formal proceedings.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and Chinese Name Generator regarding the Service and supersede any prior agreements or understandings.
